On January 1, 1864, he re-enlisted for a period of three years at Hilton Head, South Carolina. He was promoted to corporal on June 30, 1862, on sick leave July and August of that year. He was mustered out December 32, 1863 at the end of his first term, and by re-enlisting in the field at Hilton Head, as a veteran, he was paid a considerable bounty. He came back in the service as a Private, appointed to corporal February 1, 1864, and then a Sgt. in Oct. 1864 and 1st Sgt. in November 1864. On April 9, 1865 (near the end of the Civil War) he was captured by the Confederates, and was absent on the company roll from April to August as a prisoner of war. He was captured at Appomottox Court House, Virginia. From September 1865 to November 1865, he is shown absent at home as a prisoner of war for exchange. By this time though the hostilities had ceased. David Dougherty applied for an invalid pension on February 28, 1876. He states that was discharged June 13, 1865.
